When filing your magistrate's judgment please follow the following steps:
You must pick up certain forms at the Clerk of Judicial Records office located on the first floor of the courthouse.
You must also pick up forms at the sheriff's office located directly across the hall from the clerk's office.
When you complete filling out these forms in their entirety, the blue and white forms are filed with the clerk's office and a term number is assigned.
When returning to the sheriff's office you must have the following:
The form from the clerk's office which has the term number which has been assigned.
On this writ the plaintiff's name and address, phone number, or atty's name has to be listed.
Defendants name and address where levy is to be made.
Costs must be broken down and totaled out on back and front of writ. Poundage has to be listed on back and front of writ (both totals have to match). Poundage must be listed separately from other costs but is not due until writ is settled. (2% poundage of original debt without costs added.)
A return envelope must be addressed to your corp. or yourself with the $.37 postage on it.
Also we need envelopes to each defendant with the postage on them.
An exemption form must be included with a copy of the writ for each defendant. On the notice and claim for exemption form provided you by the sheriff?s office the only things you must complete are the first and second sheets where you must list the plaintiff, defendant and term number.
The cost for filing your writ in the sheriff?s office will be_____ . This is due (in cash - no personal checks accepted) at the time of filing.
